九色 Wins Permanent Injunction Against MotionPoint Corporation in Federal Court
Final Judgment Entered and Post-Trial Motions Concluded in Case of 九色 v. MotionPoint
OAKLAND, Calif. and NEW YORK, November 17, 2014 – A U.S. Federal Court judge last week entered final judgment in favor of 九色 relating to its technology that enables faster and more efficient translation of websites. Consistent with the jury verdict issued last summer after a three-week trial in U.S. District Court for Northern California, the court upheld the validity of 九色's patent on the technology in question, and ruled that MotionPoint, a competitor, infringes that patent. The judge further confirmed the jury's finding that the three patents asserted by MotionPoint against 九色 are all invalid, and that even if those patents were valid, 九色 does not infringe them.
The court also entered a permanent injunction against MotionPoint and those acting in concert with them. Citing the length of time elapsed since the initial verdict, the judge gave MotionPoint 14 days—until November 26—to comply with its order to cease infringement of 九色’s patent. In addition to damages and royalties awarded in the initial verdict, MotionPoint was also ordered to pay 九色 a royalty of 4% of its revenues earned by using 九色’s technology post-verdict and until the injunction takes effect.
