Introduction

The Centers for Medicare and Medicaid (CMS) have introduced changes that are posited to have a direct influence on how healthcare information is communicated and distributed to diverse populations, including those with limited English proficiency (LEP.). These rules were established to promote more equitable care for members – regardless of their preferred language.

The 2024 Final Rule, which came into effect January 1, 2024, revises various aspects of Medicare Advantage Part C and D plans, with particular impact felt in Marketing and Communications, Star Ratings Programs, and Provider Directories. Keeping abreast of these revisions is key to remaining compliant with CMS guidelines and broader regulatory requirements, while also providing organizations with an opportunity to make operational adjustments without impacting on quality or timelines.

CMS 2024 Final Rule Overview

Within the terms of the Final Rule is a set of comprehensive changes designed to enhance the quality and accessibility of health plans and coverage within the Medicare programs. As of 2021, the total population of individuals with LEP in the United States stands at 25.7 million, accounting for 8% of the population. As this figure continues to climb, the importance of linguistic diversity in coverage materials cannot be understated. Evidence illustrates that subpar communication is intrinsically linked to knowledge gaps and inadequate coverage relative to individual health needs, directly contributing to disproportionately poor health outcomes.

The revisions to existing guidance places emphasis on bridging these gaps through bolstered multilingual communication and marketing efforts. Namely, the Final Rule introduces several key changes to translation requirements to enforce standards of health equity, while also protecting existing and prospective beneficiaries from ambiguous or confusing marketing materials. Furthermore, it expands guidance to implement culturally competent service offerings that address the unique challenges of under-resourced communities, e.g., those living in rural or otherwise deprived communities.

Key Changes to Translation Requirements

Expanded Language Access Requirements: As outlined, a key component of the Final Rule is emphasis on the importance of clear, unambiguous, and accurate communication to all individuals. Furthermore, the rule reinforces the mandate of fulfilling translation requirements where a language is spoken by at least 5% of the population that a plan services.
Qualified Interpreters and Translation Services: Within the expansion of language services, the rule underscores the value of using qualified, subject matter expert interpreters to facilitate streamlined, accurate, culturally competent communication. Providers will therefore need to implement strategies to identify language needs within their service areas and ensure appropriate resourcing to manage translation and interpretation demand.
Cultural Competency Training: To further optimize communication with linguistically and culturally diverse beneficiaries, the CMS encourages organizations to facilitate continuous, comprehensive cultural competency training among their staff. In doing so, participating providers can assure improved understanding and sensitivity to the cultural nuances of the communities they serve, thereby proactively mitigating knowledge gaps and fostering trust between providers and their communities.

Key Changes to Alternative Format Requirements

Accessibility Standards Compliance: The Final Rule addresses the importance of accessibility in the development and distribution of coverage communications. Beneficiaries with disabilities should have equitable access to plan materials, upholding and ensuring compliance with accessibility standards across paper and digital formats, such as WCAG 2.0. This includes rendering documents and websites accessible to those with visual or cognitive impairments, and providing additional accessibility supports where needed.
Timely Provision of Alternative Formats: As part of a broader initiative to bolster accessibility in Medicare materials, the provision of alternative formats is obligatory. In other words, providers should provide beneficiaries with disabilities information in appropriate alternative formats in a timely manner. This includes formats such as large print, Braille, electronic formats compatible with screen readers, and audio recordings.
Accessibility Features in Electronic Health Records (EHRs): Elevated accessibility standards extends to the integration of accessibility features in EHRs and facilitating the seamless provision of information in alternative formats. This is indicative of broader progress towards ensuring that individuals with disabilities can independently and seamlessly access their health information.

Implications for Healthcare Providers

Investment in Language Services: Providers should assess their capacity to align with the expectations outlined in the Final Rule, with considerations for any additional investment into language services, including qualified interpreters and translation services. A comprehensive review of beneficiary language demographics against specific guidelines, such as the 5% language threshold, should be conducted to meet expanded language access requirements. This may entail closer collaboration with language service providers, or the development of in-house language access programs.
Technology Integration for Accessibility: Organizations should evaluate, and upgrade where necessary, their technological infrastructure to ensure that electronic modalities and communications, including websites and EHRs, are designed in alignment with accessibility requirements and guidelines. This may involve working with IT professionals to implement features such as text-to-speech functionality, and enhanced compatibility with assistive technologies.
Training and Education Initiatives: In compliance with cultural competency and accessibility standards as outlined by CMS, providers should prioritize training and education initiatives for their staff. This includes extensive continuous accessibility standards education and training programs focused on effective communication with diverse populations. They should also ensure that personnel are familiarized in the use of accessibility features in technology.

Medical interpretation is a crucial service throughout the healthcare industry, from hospitals, outpatient or ambulatory health centers, and assisted living communities/nursing care centers to physicians’ offices, mental health clinics, and rehabilitation centers.

Executive Order 13166, "Improving Access to Services for Persons with Limited English Proficiency,” which was signed in 2000, requires federal agencies to ensure that individuals with limited English proficiency (LEP) have access to services. This means that healthcare providers are expected to make interpreter services available to LEP patients.

Beyond the legal necessity in the United States, medical interpreters are essential because they assist in facilitating effective communication between a healthcare professional and patients who do not share a common language. This is especially important for people dealing with severe illnesses who need to understand their diagnosis and treatment options.

Communication barriers in healthcare can be unsafe and potentially life-threatening, as patients may be affected by factors such as “aggression, hindrance of care, lack of informed consent, avoidance of the healthcare system.” With the assistance of interpreters, however, patients are more satisfied, resulting in more beneficial healthcare outcomes.

Medical interpreters do more than just interpret the language. They also act as a cultural bridge between medical professionals and patients, leading to better understanding and cooperation between both parties. The International Council for Harmonization (ICH) announced revisions to its Good Clinical Practice (GCP) guidelines, marking a significant move towards more closely aligning clinical practice with the rapidly evolving technological landscape.

The purpose of the ICH and adherence to GCP standards is to safeguard the health, wellbeing and safety of clinical trial participants, establishing a clear standard for how clinical research is conducted ethically and scientifically worldwide.

What Is ICH and GCP?

ICH is a global organization which was established to unify the various stakeholders involved in the pharmaceutical industry to enforce a standard for developing, evaluating, and registering medicines in accordance with high safety, efficacy, and quality standards. Within the ICH, GCPs have been developed to ensure that safe and effective medicines are developed and registered in the most resource-efficient manner across different markets, upholding strong patient safety standards and promoting equitable global health outcomes.

Organizations that prioritize adherence to these guidelines enable efficient data exchange and ensure the integrity and security of their clinical data, enhancing organizational collaboration and driving tenacious risk mitigation strategies. With an international push towards optimized clinical research standards, there has been widespread adoption of the guidelines by leading pharmaceutical and biotech organizations, reflecting a broader move towards optimized clinical trial quality, efficacy and safety.

GCP (ICH E6) is an international ethical and scientific quality standard for designing, conducting, recording and reporting trials that involve the participation of human subjects, to provide a unified standard to facilitate the mutual acceptance of clinical data by different regulatory authorities. GCP covers aspects of monitoring, reporting and archiving of clinical trials, and incorporates addenda on the Essential Documents and on the Investigator's Brochure. Its first version was finalized in 1996, then amended in 2016 with an integrated Addendum to encourage implementation of improved and more efficient approaches to clinical trial design, conduct, oversight, recording and reporting, and including updated standards regarding electronic records and essential documents. The latest work will be the third revision to this pivotal guidance.

The GCP Update: Embracing Advanced Technology

The uptake of digital health tools and various clinical technologies has vastly widened the scope of data collection. The use of wearable devices/sensors and portable devices has been transformational in asynchronous, remote data capture, offering increased real-time insight into patients’ health and behaviours. With the incorporation of remote monitoring, decentralized clinical trials, and emphasis on improved patient centricity, the impact of advanced technology is tangible across clinical ecosystems, bridging many data gaps to facilitate robust assessments and outcomes.

The latest update to the guidelines, known as ICH E6(R3), encourages flexibility and innovation in approaches to trial planning in alignment with broader industry advancement, spotlighting technologies and trial designs that foster diverse patient input, mitigated quality risk, and efficient, simplified conduct. It primes trials to implement new and emerging data collection modalities and technologies into existing research frameworks, indicating a move towards streamlining data collection and management across different countries.

The revision to the guidelines has been drawn up to include efficiency for data management, ensuring integrity and traceability in alignment with regulatory requirements. Packaged within this, organizations continue to be encouraged to publicly register clinical trials and make the results of said trials available to the public, reinforcing a principle of transparency, and providing both patients and the public alike with key insights into the efficacy of a trial product. This is a welcome recommendation, the transparency of which is expected to foster a stronger sense of trust and au-fait to pertinent trial results where patients previously felt left in the dark in relation to the outcomes of a trial once completed.

Implications for the Future of Clinical Product Development

The newest guidance prompts the question: What does this mean for the future of clinical trials and product development?

Within its key features emerges an effort to accommodate the nuances and intricacies of an evolving clinical research, with increasing complexities deriving from the emergence of novel designs and technologies. Considerations have been made for how the guidelines can be applied in trial design characteristics, indication, and data collection methodologies. There are also heightened expectations of data systems and records management, including a simplification of retention timelines for essential record keeping, and required notifications where changes are made in investigator records. The over-arching theme is one that aims to maximize efficiency and flexibility while continuing to safeguard patient safety and data integrity.

Within the new guidance, there is an opportunity for sponsors to redefine their clinical technology and data strategy. The principle of the ICH is one of harmonization among stakeholders, which is reinforced in the guidelines via the encouragement of enhanced global collaboration on data governance, exchange, and security. Continuing to implement, or bringing onboard robust infrastructure that adheres to this principle enables those organizations to position themselves as future-thinking industry leaders. Consequently, global research stands to benefit considerably from the involvement of diverse perspectives, shared resources, and acceleration in medical research advancement.

A welcome update, ICH E6(R3) is reflective on an industry appetite to continue towards more technically agile, innovative, data-driven clinical trials. Abstract

Artificial Intelligence (AI) is the new frontier for content creation, reuse of language assets; saving time and effort in the curation of documentation. The widely adopted generative AI tools, such as ChatGPT have altered the landscape, in many instances transforming authors into editors. But can the same be said for all content? Can clinical documentation be treated like non-scientific documentation?

COAs in Clinical Studies

COAs are carefully, scientifically balanced, stress-tested Measurement tools used in patient data capture in a clinical trial. The 21st Century Cures Act (Cures Act, Public Law 114-225), defines COA as ‘‘(A) a measurement of a patient’s symptoms, overall mental state, or the effects of a disease or condition on how the patient functions; and (B) includes a patient-reported outcome.”

Capturing patients’ biometric data during a study is quantitative; however, capturing the patient experience i.e., their experience taking part in the study, with the study drug etc. is more qualitative, so item selection is not a simple exercise in creating a questionnaire for general population, but more measured and defined.

Can AI Differentiate the Subtle Complexities of Scientifically Defined Items?

Utilizing COAs¹ as metrics to assess AI interventions is essential for gaining a deeper understanding of how these interventions impact a patient’s well-being, including improvement in symptoms and quality of life. While the main objective of AI interventions may be to enhance workflow efficiency and to aid clinicians in decision-making, it remains imperative to gauge whether such interventions yield positive outcomes, or at the very least, do not adversely affect the overall lived experiences of patients. 

As outlined earlier, AI has significant potential in content creation, authoring, regulatory and literature review. These disciplines share one common thread: Volume.  

AI has been described as a data hungry technology. In other terms, it requires large data sets to make predictions and find and actuate base models. 

Challenges for COA in AI Systems 

 AI lends itself well to large datasets. It is these large datasets that inform and train the AI for best results. But not all aspects of a study are verbose. Many aspects are lean and draw from a limited word count. COAs or Measures are a set of scientifically defined questions that are crafted to deliver the patients experience of a study drug and that of the study itself; delivering qualitative² data that cannot be gathered by biometric assessments per se.

COAs are notably short in length; it is almost impossible to confidently offer an average number of items in a questionnaire, but arbitrarily let’s say the average Measure is <40 individual items, it is easy to understand this dataset does not lend itself to AI instantly. The first consideration noted above is the small dataset size. The COA data collection is fragmented and might not be a true representation of the diverse target population desired². This under representation of certain ethnic groups informs the learning of the AI system and therefore creates a scenario where the AI system not only lacks large datasets but also makes assumptions that may not be accurate. 

Lastly, these AI systems are trained and measured against a clinician’s perceptions rather than the patient outcome data. This in turn gives prioritization of clinician observations over the actual patient experience. The flip side is where we rely on the AI perception and the uncritical acceptance of the clinician as the source of truth and accuracy. 

As AI becomes more pervasive, not just in the clinical space but in real life diverse populations, there is a risk of inadvertent and unintentional bias³. Many of these AI algorithms can create a blind opaque scenario⁴ where clinicians are not able to clearly define the origins and integrity of said data. 

Indeed, language translations of these Measures go through a meticulous process⁵ to ensure that no bias is introduced into the Measure. This demanding language translation process, in combination with a cognitive debriefing component with patients, reduces the risk of introducing bias into the process. Would AI be able to divine those intricacies?

Considerations

As mentioned above, due to small datasets used in COA, collecting COAs as standard across the breadth of medical interaction would be very useful. This contributes both to the betterment of patient care and health outcomes, while also enhancing the capabilities of algorithms that support care across multiple conditions, continually incorporating the patient experience."

Particular consideration should be given to not just the measure to be used in the study, but to the actual acquisition of patient study data.

AI is a significant benefit, not just to the clinical world but to content creation broadly. In clinical studies, it is a useful tool in content creation and curation, where large data sets are available. There is considerable work being carried out on leveraging AI in Protocol design⁶. The research market is primed for colossal growth due to the increased volume of clinical knowledge. That which is being observed can be deemed “the hockey stick effect” of increasing digitizing data and the ability to leverage that data in a meaningful way. The Pharma industry is forecast to spend $4.5B by 2030.⁷ Where smaller datasets are prevalent, leveraging those larger portions of the study documentation may be used to inform the betterment of the patient.
